How to Ensure Your Rights Are Protected Upon Arrest in BC

If you are arrested in British Columbia, or anywhere in Canada, there are a number of federal laws that protect your rights. In today’s blog article, we are going to talk about what those rights are and how to ensure they are protected if you are arrested.

Your Rights

The rights that you have under federal law if you are charged or arrested, include but are not limited to the following: 

  1. The right to remain silent when questioned by police.
  2. The right to be told why you are being charged and/or arrested.
  3. The right to be told you can have, detain, instruct, and have access to a lawyer.
  4. The right to be told about accessing and how to access a lawyer 24/7 if you cannot afford one.
  5. The right to speak to a lawyer as soon as possible and in private. 

Protecting Your Rights 

The most important things to remember regarding protecting the rights that you have under federal law are to remain silent and not answer questions from the police without discussing it with a lawyer first, and to hire a lawyer to represent you as soon as possible.

Another important point is to communicate with your lawyer, if you think any of the abovementioned rights have been compromised. If, for some reason, your rights have been violated that sometimes that is grounds for a dismissal of your case.
